These Terms of Usage/Service govern your use of Nirvaan's services (“Service,” “Nirvaan,” “we,” or “us”). By using our services via any Platform, including the Nirvaan Application (“App”) or Website (“Web”) (collectively, “Platform”), you accept these terms and conditions in full. If you disagree with any part of these terms and conditions, you must not use the Services.

The provision of Services (whether via the app or the web) uses cookies. By using this Service and agreeing to these terms and conditions, you consent to our use of cookies in accordance with the terms of Nirvaan's Privacy Policy.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and “You are" refer to you, the person logged on to this website and compliant with the Company’s terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves. All terms refer to the offer, acceptance, and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of the provision of the Company’s stated services, in accordance with and subject to, prevailing law of Netherlands. Any use of the above terminology or other words in the singular, plural, capitalization, and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Terms of Usage/Service for Nirvaan's Services

By using the Service in any way, you are agreeing to comply with and be bound by this Privacy Policy and Terms of Usage, as applicable (collectively “Related Agreements”), and all rules, policies, and disclaimers posted on the Service or about which you are notified (collectively “Terms”). If you do not agree with all the Terms, or if you are under the age of Eighteen (18), do not use the Service. Please review all of the Terms carefully before using the Service.

By using the Service, you (i) agree to be bound by the Terms and (ii) represent that you are over the age of Eighteen (18) and able to form legally binding contracts.

Please note that these Terms provide that if you and Nirvaan are unable to resolve any disputes that arise between you and Nirvaan, the dispute will be resolved by a specific dispute resolution process that may include arbitration. Arbitration is binding and is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than in court, and is subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. You also agree that any claims or disputes cannot be brought as a class action. Please carefully review the Dispute Resolution section.

License to use Application and Website

Unless otherwise stated, Nirvaan and/or its licensors own the intellectual property rights in the Platform and material on the Platform. Subject to the license below, all these intellectual property rights are reserved.

Nirvaan hereby grants you a non-exclusive, non-transferable subscription to use the Service during the Term, solely for your personal/internal use in accordance with the use parameters described in the order form utilized to order such subscription and subject to these Terms of Service.

You shall not modify, reverse engineer, decompile, disassemble, or attempt to derive the source code of Nirvaan’s web Service or assist any other person or entity in doing so. You acknowledge that all content, including but not limited to text, software, music, sound, photographs, video, graphics, or other material contained in listings, sponsor advertisements, or email-distributed, commercially produced information presented to you by the Service, by Nirvaan, Users, or other content providers, is protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute in any way content available through the Service, including code and software for commercial purposes. For permission to use third-party materials appearing on the Service, please contact the copyright owner. You do not acquire ownership rights to any content, document, or other materials viewed through the Service. The posting of information or materials on the Service does not constitute a waiver of any right in such information and materials.

Users may categorically note that any use or reliance on any content posted or obtained from usage is completely at your own risk and consequences. Nirvaan does not subscribe, endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any content or communications posted, nor endorse any opinions expressed therein. Users must know that they may be exposed to content that might be unpleasant, offensive, harmful, inaccurate, deceptive, frivolous, fake, or otherwise inappropriate. All content is the sole responsibility of the person who originated, posted, left, or published in any manner such content. Nirvaan may not monitor or control the content posted via the Services and, therefore, cannot, in any manner, take responsibility for such content.

We reserve the right to remove content that violates the User Agreement, including but not limited to intellectual property violation, infringement, misappropriation, impersonation, unlawful conduct, or harassment. Users may report any such content by email at Contact@nirvaan.org.in.

You grant Nirvaan a non-exclusive, irrevocable, perpetual, worldwide, royalty-free, sublicensable (through multiple tiers) license to use, reproduce, display, edit, copy, modify, transmit, publicly perform, extract, analyze, research, and create derivative works from content that you have provided or have left in your posts, in any media now known or not currently known.

This licensed right may be exercised to provide the Service and for other purposes.

You are consciously aware that while using Nirvaan, you are solely responsible for your actions, omissions, or conduct, and Nirvaan shall not be responsible in any manner whatsoever. You shall be solely liable for any violation of any applicable central or state laws. You undertake to unconditionally indemnify Nirvaan against any loss, liability, and consequences arising out of your actions or omissions.

By using Nirvaan to collect data from and optimize your social media channels or with any third party, you also agree to be bound by their Terms of Service.

Setting up Your Account

You must provide accurate and complete information, including your legal full name, a working email address, and any other information requested during the account signup process to obtain an account and use the Service, and update this information if it changes.
You must be a human being to set up an account and use the Service. Accounts may not be created by “bots” or other automated methods.
You are responsible for keeping your account and password secure and are also responsible for all activities using your account or password. Nirvaan is not liable for any loss or damage that results from your failure to comply with this obligation or unauthorized use of your account.
You may never use another’s account without permission.
You must notify Nirvaan immediately of any breach of security or unauthorized use of your account.
You must inform Nirvaan’s Admin immediately about any sort of harassment, abuse, verbal abuse, or trolling, etc. However, under any circumstances, the user cannot hold Nirvaan liable for any of the aforesaid consequences.

Terms and Conditions for Nirvaan Unlimited Therapy Plan

1. Subscription Details

2-Week Plan: Includes 6 sessions.
4-Week Plan: Includes 13 sessions.
9-Week Plan: Includes 27 sessions.

2. Session Timelines

Sessions must be completed within the specified plan duration.

Extensions may be granted for genuine cases at our discretion.
No sessions or refunds will be available after the timeline has expired.

3. Cancellation Policy

Cancellation is only available after 75% completion of the therapy sessions.

No refunds will be issued for incomplete plans unless the cancellation criteria are met.

4. Conduct

Any abusive language or behavior will result in immediate termination of services without a refund.

5. Modification Rights

Nirvaan reserves the right to modify these terms and conditions at any time. Users will be notified of any changes via email or the website.

By purchasing any therapy plan from Nirvaan, you agree to these terms and conditions. If you have any questions or need further clarification, please contact us at contact@nirvaan.org.in.

Teleconsultation or Diagnostic Services

Nirvaan enables you to connect with psychologists, doctors, registered medical practitioners, and diagnostic service providers through various modes available on its app and website for availing various services and also allows you to buy various products available on its Platform.

You should know that Nirvaan collects your information for the provision of the Services and allied/ancillary purposes, which may be shared with the various registered practitioners, who shall be providing eligible services. Information to be collected includes but is not limited to, name, father’s name, address, medical history, email, and mobile number.

You must know that Nirvaan is not involved in providing any healthcare services and therefore is not responsible for any interactions between you and such practitioners or for availing any medical services through this platform in any manner whatsoever.

You warrant and represent that:

You are entitled to post the Comments on our website and have all necessary licenses and consents to do so;
The Comments do not invade any intellectual property right, including without limitation copyright, patent or trademark of any third party;
The Comments do not contain any defamatory, libelous, offensive, indecent or otherwise unlawful material which is an invasion of privacy
The Comments will not be used to solicit or promote business or custom or present commercial activities or unlawful activity.

You hereby grant NIRVAAN a non-exclusive license to use, reproduce, edit, and authorize others to use, reproduce and edit any of your Comments in any and all forms, formats, or media.

Hyperlinking to our Content

The following organizations may link to our Website without prior written approval:

Government agencies;
Search engines;
News organizations;
Online directory distributors may link to our Website in the same manner as they hyperlink to the Websites of other listed businesses; and

No use of NIRVAAN's logo or other artwork will be allowed for linking absent a trademark license agreement.

Booking and Payment:

Booking for various healthcare services made available by Nirvaan shall be done at its app or website which may have third-party links and a generally acceptable payment mechanism. You agree that you shall not hold Rocket Health liable or accountable for any payment made for any product and services, however, Nirvaan will assist you in case of any difficulty or for required assistance.

Cancellation and Refund:
You should know that cancellation and refund for any products purchased are governed by the terms of such product catalog. For availing healthcare services, cancellation or rescheduling for the booking can be done 24 hours prior to the appointment.

Session Timing:
- Booking a specific time slot does not guarantee an exact start time.
- Sessions will be scheduled within a 48-hour window from the booked time.
Refund Policy:
- If we fail to offer the session within the specified 48 hours, a full refund will be issued.
- No refund will be provided for sessions canceled due to the use of harsh or inappropriate language.
Conduct:
- Respectful communication is mandatory.
- Any use of harsh or inappropriate language will result in immediate termination of the session with no refund.
Rescheduling:
- Clients may reschedule sessions within the 48-hour window without any penalties.
- Rescheduling requests must be made at least 12 hours prior to the original appointment.
Cancellation Policy:
- Sessions canceled by the client with less than 24 hours' notice are non-refundable.
- Sessions canceled by Nirvaan will be rescheduled within the 48-hour window or refunded if rescheduling is not possible.
Confidentiality:
- All session details and client information are kept confidential.
- Any breach of confidentiality by the client may result in termination of services.
Payment Terms:
- Full payment is required at the time of booking.
- Payment methods accepted include credit/debit cards and online banking.
Technical Issues:
- Clients are responsible for ensuring a stable internet connection and a functional device for online sessions.
- Nirvaan is not liable for session disruptions due to technical issues on the client's end. Sessions will be rescheduled only if disruptions are due to technical issues on Nirvaan’s end.
Therapist Availability:
- Therapist availability is subject to change. Clients will be notified promptly of any changes and given the option to reschedule.
- In cases where the assigned therapist is unavailable, an alternative therapist may be offered.
Session Recording:
- Sessions are not recorded unless explicitly agreed upon by both client and therapist for therapeutic purposes.
- Any recording without mutual consent is prohibited and may result in termination of services.

Content Liability

We shall not be held responsible for any content that appears on your Website. You agree to protect and defend us against all claims that are rising on your Website. No link(s) should appear on any Website that may be interpreted as libelous, obscene, or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third-party rights.
